Terms of Use

1.Parties and Definitions

Provider: VELCORE TECHNOLOGY LIMITED, trading as Esnaf Max (Incorporation No. 80005054). Registered office: Unit 1603, 16th Floor, The L. Plaza, 367 - 375 Queens Road Central, Sheung Wan, Hong Kong.

In these Terms, the following expressions have the meanings set out below:

1. (a) “Site”: the website made available at esnafmax.com and any related sub-domains.
2. (b) “Services”: sector-specific website setup, hosting, publishing, subscription and related support.
3. (c) “Customer Site”: the website created, hosted or published for you.
4. (d) “Content”: text, images, logos, contact details and other materials you provide.
5. (e) “Subscription”: the recurring paid arrangement under which the Services are provided for a selected plan and period.

2.Scope and Acceptance

These Terms apply to all use of the Site, including visiting the Site, creating an account, starting a trial, placing an order and using the Services.

If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

Our Privacy Policy, Refund & Cancellation Policy and Cookie Policy form part of these Terms. If there is a conflict on fees or refunds, the Refund & Cancellation Policy prevails on those points.

3.Description of Services

Esnaf Max provides businesses with sector-specific digital presence. Depending on the plan selected at the time of order, the Services may include:

1. (a) Ready-made, customisable website templates and content structure for selected sectors
2. (b) Adaptation based on your business name, contact details, colour palette and sector
3. (c) Publishing and hosting of the Customer Site, together with basic technical maintenance
4. (d) Core features for contact, appointment requests and promotion
5. (e) Limited content and settings management through an account dashboard

4.Eligibility and Account

The Services are intended primarily for business customers. By creating an account you represent that you are at least 18 years old and that the information you provide is accurate, current and complete.

You are responsible for keeping your login credentials confidential and for all activity under your account. You must notify us promptly of any unauthorised access.

You may not create multiple accounts to abuse the Services or to mislead third parties. We may suspend or terminate accounts used in this way.

5.Free Trial

Eligible new customers may be offered a free trial for the period stated on the Site at the time of sign-up (typically 60 days). The scope and length of any trial are those described at registration or order.

During a trial you may use the Services without payment. If you cancel before the trial ends, no fee is charged unless we have clearly stated otherwise.

After the trial, a valid payment method is required to collect the Subscription fee. If payment cannot be collected, the Customer Site may be taken offline.

6.Subscription, Fees and Payment

Fees are charged at the amount, currency and period shown on the pricing page at the time of order. Taxes and any additional charges are set out in the order summary.

Payments are processed by our payment provider, Stripe. We do not store card numbers on our servers. Failed payment may result in suspension of the Services.

Unless cancelled, a Subscription renews at the end of the selected period. Cancellation and refunds are governed by the Refund & Cancellation Policy.

We may change prices on reasonable prior notice. A change applies to renewal periods commencing after the effective date.

7.Customer Content and Licence

You retain your rights in the Content. You grant us a worldwide, non-exclusive, royalty-free licence to use, copy, host, publish, display and back up the Content solely to provide the Services and to meet our legal obligations.

You represent and warrant that the Content is lawful and accurate, that it does not infringe third-party rights, and that you hold all required permissions, trade marks and copyrights.

After the Services end, we will delete or render the Content inaccessible within a reasonable time, except where we must retain records by law. We are not obliged to keep backups of a published Customer Site indefinitely.

8.Acceptable Use

You must use the Services and the Customer Site only for lawful purposes. In particular, you must not:

1. (a) Publish misleading, unlawful, defamatory or otherwise improper content
2. (b) Infringe the intellectual property, trade marks, personal data or trade secrets of others
3. (c) Distribute malware, disrupt or overload the Services, or attempt unauthorised access
4. (d) Engage in spam, fraud, phishing or similar abuse
5. (e) Copy, reverse engineer or resell the software or templates except as expressly permitted

9.Intellectual Property

The Esnaf Max name, logo, software, templates, design system and Site content belong to VELCORE TECHNOLOGY LIMITED or its licensors. These Terms do not transfer any intellectual property except the limited rights expressly granted.

Rights in the templates and software used on a Customer Site remain with us. You receive a non-exclusive, non-transferable right to use them solely during the Subscription. That right ends when the Subscription ends.

You may not copy, reproduce, frame or commercially exploit Site content without our prior written consent.

10.Service Level and Support

We provide the Services with reasonable care and skill. Temporary interruptions may occur due to hosting, maintenance, security updates or events outside our control.

We do not warrant uninterrupted or error-free service, or any particular search-engine ranking. Visibility depends on content, competition and third-party algorithms.

Support is provided, as a rule, by email and the contact channels stated on the Site during business hours. Custom development, third-party integrations and legal advice are outside the scope of the Services.

11.Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available”. Implied warranties of merchantability, fitness for a particular purpose and non-infringement are disclaimed.

Domain registration, SSL, third-party payments, maps, messaging or analytics are subject to the terms of the relevant provider. We are not responsible for failures of those services.

12.Limitation of Liability

To the maximum extent permitted by law, we are not liable for loss of profit, business interruption, loss of data, loss of goodwill, or any indirect, incidental or punitive loss.

Our aggregate liability arising out of or in connection with the Services is limited to the net fees you paid us in the twelve (12) months immediately before the event giving rise to the claim. If no fees were paid, our liability is zero, except for rights that cannot be excluded by law.

Nothing in these Terms limits liability for fraud, wilful misconduct or any liability that cannot lawfully be limited.

13.Indemnity

You shall indemnify, defend and hold harmless VELCORE TECHNOLOGY LIMITED and its officers from and against any claim, loss, cost and reasonable legal fees arising out of your Content, your use of a Customer Site, your breach of these Terms, or your infringement of third-party rights.

14.Suspension and Termination

You may end your Subscription at any time in accordance with the Refund & Cancellation Policy. Termination generally takes effect at the end of the current paid period.

We may suspend or terminate an account immediately for non-payment, acceptable-use violations, legal risk or abuse of the Services.

On termination, the Customer Site may be taken offline and dashboard access may end. Except for records we must keep by law, we may delete your data.

15.Privacy

Processing of your personal data is described in our Privacy Policy. By using the Site you acknowledge that policy.

16.Force Majeure

We are not liable for failure to perform caused by events beyond our reasonable control, including natural disaster, epidemic, war, terrorism, strike, infrastructure or internet outage, power failure or legal prohibition. Time for performance is extended for the duration of the event.

17.Governing Law and Disputes

These Terms are governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules.

The courts of Hong Kong have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. Rights that mandatory consumer law gives you remain unaffected.

These Terms are issued in Turkish and English. If there is any inconsistency, the English version prevails.

18.General

1. (a) Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign the Services or this agreement in connection with a merger, transfer or reorganisation.
2. (b) Severability: If a provision is held invalid, the remaining provisions continue in force and the invalid provision is deemed modified to the minimum extent necessary to make it valid.
3. (c) Waiver: Failure to enforce a right is not a waiver of that right.
4. (d) Entire agreement: These Terms, together with the policies referred to, constitute the entire agreement on the subject matter and supersede prior oral or written statements.
5. (e) Notices: We may notify you at the email address on your account or by notice on the Site. Notices to us must be sent in writing to support@esnafmax.com.

19.Changes

We may update these Terms from time to time. The current version takes effect when published on this page. We will give reasonable notice of material changes by email or on the Site. Continued use of the Services after a change constitutes acceptance of the updated Terms.
